Terms of Service
Last updated October 25, 2026
This document is a draft that is being finalized. It is not yet in effect.
These terms are an agreement between you and Arkenly LLC, a Wyoming limited liability company (“Arkenly LLC”, “we”, “us”), which runs NexoPages (the “Service”), including nexopages.com, the NexoPages app and the pages we host for you. By creating an account or using the Service you agree to these terms. If you use the Service for a business, you agree on its behalf.
1. Your account
- You must be at least 16 years old and able to form a binding contract.
- Give accurate details, keep your sign-in methods secure, and tell us at [email protected] if you think someone else has accessed your account.
- You're responsible for what happens in your account, including what people you invite do.
2. Your page and your content
- You keep all rights to the content you add: text, photos, logos, prices and the rest (“Your Content”).
- You give Arkenly LLC a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example, resize images or translate on your request) and display Your Content, only to run, secure and improve the Service and to show your page to visitors. This licence ends when Your Content is deleted from the Service, except for copies kept in backups for the periods in our Privacy Policy.
- You confirm that you have the rights to Your Content and that it, and your use of the Service, follow our Acceptable Use Policy and the law.
- Templates come with sample words and images. Before you go live, make sure what your page says about your business is true: prices, hours, services, qualifications and reviews.
3. Your customers
People who visit your page may send you messages, book appointments or sign up to your list. For their personal information you are the business responsible for it (the “controller”), and we process it for you to run the Service (as a “processor”). You agree to:
- have a lawful reason to collect and use their information, and tell them how you use it;
- only send them marketing they have agreed to, and honour unsubscribe and deletion requests;
- not collect sensitive information (such as health details or government ID numbers) through the Service unless the law allows it and you have their explicit consent.
Our handling of this information is described in our Privacy Policy. If you need a data processing agreement, write to [email protected].
4. Bookings and payments with your customers
Appointments, sales, deposits and refunds are between you and your customers. Arkenly LLC is not a party to them. When you use a payment provider (for example, a payment link or a connected Stripe or PayPal account), that provider's terms also apply.
When you sell through your connected Stripe or PayPal account, you are the seller: payments go directly to your account, and you're responsible for what you sell, delivering it, refunds, disputes, receipts the law requires, and taxes. We don't hold your customers' money or card details. Products you sell must follow our Acceptable Use Policy; we may switch off selling on a page that doesn't.
5. AI features
Paid plans can change pages by request and draft replies to customers using AI. AI suggestions can be wrong or incomplete: you see a preview or draft and decide whether to use it, and you're responsible for what you publish or send. Requests are processed by our AI provider as described in our Privacy Policy and are not used to train its models. Monthly limits and fair-use caps apply.
6. Plans, billing and cancellation
- Free plan. The Free plan costs nothing. Free pages show a small “Made with NexoPages” badge. On the Free plan, card sales through your connected Stripe account carry a 5% Arkenly LLC fee, collected by Stripe from each sale; payment links and PayPal carry no Arkenly LLC fee. Paid plans have no fee on sales.
- Trial. New accounts may get a free trial of paid features. When it ends, your account moves to the Free plan unless you choose a paid plan. We don't take a card for the trial.
- Subscriptions. Paid plans are billed in advance, monthly or yearly, through our payment provider (Stripe). They renew automatically until you cancel.
- Cancelling. You can cancel any time in Settings. Your plan continues until the end of the period you've paid for, then your account moves to the Free plan. Paid features pause; your content isn't deleted.
- Refunds. Payments are non-refundable except where the law requires a refund or where we say otherwise in writing, as set out in our Refund Policy. If you think a charge is wrong, write to [email protected].
- Price changes. We'll tell you at least 30 days before a price change applies to your subscription. If you don't agree, you can cancel before it takes effect.
- Taxes. Prices are in US dollars and don't include taxes, which are added where required.
- Failed payments. If a payment fails and isn't fixed, your account moves to the Free plan.
- AI edit credits. Monthly AI edits and top-ups expire as shown in the app and have no cash value.
- Referrals. When a business that signed up through your invite link or your page's badge starts a paid plan, you earn one free month of the Starter plan (the number in force when that business starts paying): a month of Starter if you're on the Free plan (starting after your trial, if you're on one), or the price of a Starter month off your next invoices if you already pay. One reward per referred business, no matter how long they pay; your own accounts don't count. Rewards have no cash value and can't be transferred. We may withhold or reverse rewards obtained through fake accounts, spam or other abuse, and we may change or end the program for future referrals.
7. Other services
The Service connects to services we don't control, such as Google Calendar, Google Sheets, Google Business Profile, YouTube, Stripe, PayPal, Mailchimp, Kit, WhatsApp, Instagram and TikTok. Your use of them is governed by their terms. We're not responsible for them, and features that rely on them may change if they change.
8. Our rights
The Service, its software, design, templates and the NexoPages name and logo belong to Arkenly LLC or its licensors. You may use templates and their sample content for your page on the Service. If you send us ideas or feedback, we may use them without owing you anything.
9. Suspension and ending
- You can delete your account at any time in Settings. Your page goes offline straight away and your data is deleted as described in our Privacy Policy.
- We may remove content, or suspend or close an account, if we reasonably believe it breaks these terms or the law, puts people at risk, or exposes us to liability. Where it's appropriate and safe, we'll tell you why and give you a chance to fix it or appeal by writing to [email protected].
- We may change or stop parts of the Service. If we stop the whole Service, we'll give you at least 60 days' notice and a way to export your data.
10. Disclaimers
We work hard to keep NexoPages fast, secure and available, but the Service is provided “as is” and “as available”. To the extent the law allows, Arkenly LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not promise that the Service will be uninterrupted, error-free, or that it will bring you any particular number of customers or bookings.
11. Limit of liability
To the extent the law allows: (a) Arkenly LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) Arkenly LLC's total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places don't allow these limits, so they may not apply to you.
12. Indemnity
If someone brings a claim against Arkenly LLC because of Your Content, your dealings with your customers, or your breach of these terms or the law, you'll cover the reasonable costs and losses that result, to the extent the law allows.
13. Law and disputes
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Wyoming, unless the law where you live gives you the right to bring a claim in your local courts. Before going to court, please write to [email protected] so we can try to resolve it. Nothing in these terms takes away rights you have as a consumer under the law where you live.
14. Changes to these terms
We may update these terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, the new terms apply; if you don't agree, you can delete your account.
15. Everything else
These terms, with the policies they link to, are the whole agreement between you and Arkenly LLC about the Service. If part of them can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of the Service.
